Common Practice on Black and White trade marks

On 15 April 2014, IP offices, including the UKIPO, that are to implement the Common Practice of the Scope of Protection of B&W marks published a communication detailing the Common Practice, which can be found here.

The Common Practice is intended to increase transparency, certainty and predictability for both users and examiners, and came into force on 2 June 2014, following its publication in the OHIM Guidelines (though please note that the Common Practice will not come into force in the UK until 15 July 2014).
